1. Terms of Sale

1.1. These Terms of Sale apply to the purchase of goods and services between the buyer of the online store www.meditsiinigrupp.ee/pood and the company Meditsiinigrupp AS (hereinafter referred to as Meditsiinigrupp).

1.2. In addition to these terms, the legal relations arising from the purchase of products from Meditsiinigrupp’s online store are governed by the Law of Obligations Act (hereinafter LOA), the Consumer Protection Act (hereinafter CPA), and other legal acts valid in the Republic of Estonia.

1.3. Meditsiinigrupp reserves the right to amend these Terms of Sale. Such amendments will be published on the website www.meditsiinigrupp.ee/pood/muugitingimused/.

1.4. The product images in the online store are illustrative and may differ from the actual products.

1.5. Unintentional errors may occur in the descriptions of products in the online store. We recommend checking the information on the manufacturers’ websites.

1.6. Meditsiinigrupp has the right to withdraw from a sales contract concluded via the e-shop without sanctions and not deliver the ordered goods or provide the service in the following cases:
– the goods are out of stock;
– the price or characteristics of the goods were displayed incorrectly in the e-shop due to a system error;
– if the buyer does not meet the conditions set by Meditsiinigrupp.ee.

If Meditsiinigrupp is unable to fulfill the order, Meditsiinigrupp will contact the buyer and refund the paid amount if the buyer has made an advance payment for the goods.

2. Prices

2.1. All prices displayed in the Meditsiinigrupp online store are in euros (EUR) and include VAT.

2.2. Shipping costs will be added to the price according to the delivery method chosen by the buyer.

2.3. Prices are valid from the moment the order is placed until the payment deadline for the placed order expires (1 day after placing the order).

3. Placing an Order

3.1. Add the desired product to the shopping cart.

3.2. To view the contents of your shopping cart, select “Shopping Cart” from the top right corner of the website.

3.3. To place an order, fill in the required data fields with your information.

3.4. Choose your preferred product delivery method.

3.5. After entering your details, choose your preferred payment method. In our e-shop, you can pay via Swedbank, SEB, LHV, Coop, Citadel, and Luminor bank links; card payment (Visa, MasterCard), and regular invoice. It is also possible to choose Liisi installment payment or Liisi3 payment solution.

3.6 To confirm your order, check the box next to “yes, I agree to the terms and conditions” and then select “Proceed to Payment”.

3.7. Orders placed in the online store are processed on weekdays, Monday-Friday, from 9:00 AM to 3:00 PM. If an order is placed on Friday after 2:00 PM, it will be processed on the following Monday.

4. Entry into Force of the Sales Contract

4.1. With the sales contract for goods, Meditsiinigrupp undertakes to transfer to the buyer existing, manufactured, or future goods acquired by Meditsiinigrupp and to enable the transfer of ownership to the buyer, while the buyer undertakes to pay Meditsiinigrupp the amount indicated on the invoice for the goods and to accept the goods.

4.2. Orders that have not been paid for will be cancelled after 7 days from the date of placing the order.

4.3. The sales contract enters into force after the buyer’s payment has been received in Meditsiinigrupp’s bank account.

5. Delivery

5.1. After the sales contract enters into force, the ordered goods can be received according to the chosen delivery method:

5.1.1. The courier company will deliver the goods to the address specified in the order;

5.1.2. The goods will be sent to the parcel locker specified in the order;

5.2. The delivery times indicated on the e-shop website are valid from the moment the order amount is received in the e-shop’s bank account.

5.3. For delivery without delay, care must be taken and accurate and valid delivery information must be provided when placing the order.

5.4. Meditsiinigrupp is not responsible for delays in the delivery of goods if the goods were handed over to logistics partners on time, but the delay in delivery is due to circumstances that Meditsiinigrupp could not influence or foresee.

6. Right of Return

6.1. After receiving the order, the buyer has the right to withdraw from the contract concluded in the e-shop within 14 days. The 14-day right of return applies only to private consumers. The 14-day right of withdrawal does not apply to legal entities.

6.2. The returned product must be unopened and complete (including product packaging and all items contained within the product packaging, etc.). If the product was purchased as part of a campaign where another product was added to the item, you must return the entire set (i.e., all products).

6.3. In the event of deterioration of the returned goods, the buyer is responsible for the decrease in value resulting from the use of the item. To ascertain the nature, characteristics, and functioning of the goods, the buyer should only handle and use the item as they would normally be allowed to do in a store.

6.4. To return an item, a free-form withdrawal application from the purchase must be submitted and sent to pood@meditsiinigrupp.ee within 14 days of receiving the item.

6.5. The buyer must return the goods within 14 days following the submission of the application or provide proof that they have handed over the goods to a logistics company within the aforementioned period.

6.6. Upon receipt of the withdrawal application, Meditsiinigrupp will promptly, but no later than 14 days, refund to the buyer all payments received from the buyer under the contract, including the delivery costs of the item used by the buyer, except if the buyer has explicitly chosen a delivery method different from the cheapest delivery method offered by Meditsiinigrupp; Meditsiinigrupp is not obliged to refund costs exceeding those associated with the standard delivery method.

6.7. All direct costs of withdrawing from the purchase shall be borne by the buyer.

7. Force Majeure

7.1. Meditsiinigrupp is not responsible for damages caused to the Customer or delays in the delivery of goods if the damage or delay in delivery is due to circumstances that Meditsiinigrupp could not influence or foresee.

8. Processing of Personal Data

8.1. By entering data in the online store and providing the corresponding confirmation, the buyer grants the right to collect and process the buyer’s personal data (name, contact phone, parcel delivery and/or home address, email address) and to transfer personal data to logistics partners for the delivery of goods.

8.2. Meditsiinigrupp has the right to use the buyer’s contact details for sending advertisements and other information to the buyer.

8.3. The buyer has the right at any time to prohibit the collection and use of their personal data, except when it is necessary for enforcing a claim arising from the contract or for the delivery of goods.

8.4. Encrypted data communication with banks when paying for purchases ensures the security of the buyer’s personal banking credentials, and the online store also has no access to them.

9. Procedure for Submitting Complaints

9.1. Meditsiinigrupp is responsible for non-conformity or defects of goods sold to the buyer that appear within two years from the date of delivery of the goods to the buyer. For legal entities, we provide a 3-month period for submitting complaints.

9.2. In the event of a defect, the buyer has the right to contact Meditsiinigrupp within two months, by presenting the invoice used for the purchase of the goods. Notification of non-conforming goods must be sent to Meditsiinigrupp’s email address pood@meditsiinigrupp.ee or by calling +372 6140 801. Should the buyer fail to notify Meditsiinigrupp of the non-conformity of the goods within the period specified in this clause, Meditsiinigrupp shall be released from liability for the non-conformity of the goods.

9.3. In the event of a defect in the goods, please cease using the goods.

9.4. Meditsiinigrupp is responsible for non-conformity and defects of the goods that appear within 2 years from the date of delivery of the goods to the user, as follows:

– within the first six months from the moment of delivery of the goods, it is presumed that the non-conformity of the goods already existed at the time of delivery, i.e., the burden of proof for the conformity of the goods’ quality lies with Meditsiinigrupp.

– after six months from the moment of delivery of the goods, the burden of proof for the non-conformity of the goods’ quality lies with the buyer.

9.5. Meditsiinigrupp and the buyer shall agree on the repair or replacement of defective goods.

9.6. Meditsiinigrupp is not responsible for defects in the goods caused by the buyer’s fault, which have arisen as a result of improper storage or use of the goods.

9.7. In the event of non-conformity or defects in the goods, please submit a claim to pood@meditsiinigrupp.ee, stating the name of the orderer, contact phone number, order number, and a precise description of the non-conformity or defect of the goods.

9.8. A complaint regarding the discovery of non-conformity or a defect in the goods must be submitted within two months from the discovery of the non-conformity or defect.

9.9. All complaints will be reviewed, and the buyer will be contacted as soon as possible, but no later than within 14 days from the receipt of the complaint.

9.10. The buyer has the right to demand from Meditsiinigrupp a reduction in the purchase price or termination of the contract and a refund for the goods if Meditsiinigrupp is unable to repair or replace the goods, or if the repair or replacement of the goods fails.

10. Buyer’s Right to Appeal to the Consumer Disputes Committee

10.1. If Meditsiinigrupp has refused to resolve the buyer’s complaint or the buyer is not satisfied with the solution offered by Meditsiinigrupp and believes that their rights have been violated or interests harmed, the buyer may submit a complaint to the Consumer Disputes Committee through the Consumer Protection and Technical Regulatory Authority. The buyer may submit a complaint themselves or through a representative. The details of the Consumer Disputes Committee are provided on the website of the Consumer Protection and Technical Regulatory Authority, and for resolving issues arising in EU member states, contact the European Consumer Centre.
